Garvey Schubert Barer state and local tax attorney Michelle DeLappe was quoted in an article by the national publication State Tax Notes on a recent decision in which a federal judge approved a jury trial for a Puerto Rico case involving the taxation of several online travel companies. Michelle weighed in on the government’s reason for requesting a jury trial: “The trial may be related to the nature of hotel occupancy taxes, which she said reflects a general desire to shift as much of the tax liability as possible to people from outside the state.” She continued: “These larger companies look like they have deep pockets, so a jury composed of people local to the jurisdiction is more likely to favor the home team.” The parties have since entered a settlement agreement resolving the case.
