Overview

Andrew Richards represents clients in the commercial fishing, seafood processing and shipbuilding and repair industries.  Andrew’s practice includes litigation of commercial, maritime and regulatory matters; providing counsel to trade associations and other organizations, including antitrust counseling; defense of fishery enforcement actions; advocacy before fishery management councils and agencies; and assistance with commercial transactions.

Andrew is admitted to practice in Alaska, Oregon and Washington and has appeared in state and federal courts in each of those states.  He has also represented clients in administrative actions before the National Marine Fisheries Service and the Government Accountability Office.  Before entering private practice, Andrew clerked for a federal judge in Alaska and then joined the U.S. Department of Justice in Washington, D.C., through its Honors Program.  Andrew got his start in the working world as a deckhand on his father’s commercial salmon troller in Southeast Alaska.

Litigation

Secured significant reduction in government fee assessed against owners of fishing vessels in Pacific whiting fishery after appeal to Ninth Circuit

Obtained federal agency’s agreement to revise regulations affecting fishing company client’s business after initiating litigation challenging regulations

Helped client avoid potential significant fine and loss of business by convincing federal agency that harvest restrictions did not apply to client’s commercial fishing operation

Obtained dismissal of claim challenging client’s ownership of crab permit

Representation in claims relating to shipyard work

Antitrust Counseling and Defense

Developed guidance for commercial fishing organization client’s compliance with antitrust exemption

Assisted seafood trade association client with third-party collection of commercially sensitive information

Represented commercial fishing organization client in investigation by antitrust section of a state attorney general office

Commercial Transactions

Drafting and review of a variety of transactional documents, including vessel purchase and sale agreements, vessel construction and repair agreements, LLC agreements and finance agreements

Formation of limited liability companies and nonprofit organizations
