Alan Sherbrooke advises clients on the full range of issues that arise under federal and state antitrust laws, including resale price maintenance; vertical nonprice restraints and other dealer relations issues; tying arrangements; exclusive contracting; price discrimination; monopolization; and horizontal restraints such as price-fixing, market divisions and boycotts. He assists clients in identifying and minimizing potential antitrust liability arising from mergers, acquisitions and joint ventures.
In the event a client is investigated or sued for anticompetitive activities, Mr. Sherbrooke provides representation in administrative proceedings and negotiations with the Department of Justice, the Federal Trade Commission, or state attorneys general, and directs strategy in antitrust litigation.
His experience includes representation before state and federal enforcement agencies in connection with hospital acquisitions; administrative litigation involving the scope of antitrust immunity for joint purchasing and leasing in the transportation industry; and litigation involving access to natural gas transmission lines.
Mr. Sherbrooke presents seminars for clients covering basic principles of antitrust law and techniques for identifying and safely dealing with potentially dangerous competitive situations and documents.
In addition to his antitrust and trade regulation practice, Mr. Sherbrooke has extensive experience in federal and state regulation of transportation, including service contracts; restrictions on vessel operations imposed under the Jones Act; the Maritime Security Act of 1996's limitations on use of subsidized vessels in domestic trades; and regulation of foreign shipping lines under the Controlled Carrier Act and Foreign Shipping Practices Act.
