Litigation and Alternative Dispute Resolution
Professional Liability Litigation
More Litigation Against More Professionals
Litigation involving nonmedical professionals has been steadily increasing over the past few years. This includes accountants, financial planners and advisers, securities brokers and dealers, attorneys, insurance entities and corporate directors and officers. While much of this has been fueled by the recent financial disruption, it is also the result of plaintiffs' attorneys seeking to expand the pool of defendants and, in turn, the amount of insurance to be targeted.
Years of Experience Defending Professionals
Garvey Schubert Barer has years of experience representing professionals not only in the financial services arena but also in a wide spectrum of commercial disputes. To all these matters we bring exceptional expertise and a comprehensive understanding of the industries in which clients work.
Many of our attorneys are also CPAs, which gives us significant insight into professional liability matters against such professionals or involving accounting issues. One of our lawyers formerly served as a senior vice president for three major insurance companies, giving us unique perspective in representing not only carriers but also agents and brokers. In addition, one of our attorneys has served as counsel to the largest association of independent NYSE floor brokers.
Our services often involve defending clients in lawsuits. But we also represent them in administrative proceedings, including representing broker-dealers in disciplinary matters before the NYSE and FINRA.
In-Depth Financial Sector Experience
Garvey Schubert Barer has been selected as one of a limited number of firms with the experience and expertise to represent the FDIC in connection with the current financial crisis. We have represented it in numerous lawsuits filed by the agency against individuals and entities involved in failures of banks and other financial institutions.
Our law firm is one of only a handful of firms nationally that possess the experience and expertise required to successfully prosecute these lawsuits. The experience we have gained from over 30 lawsuits against professionals in the financial sector provide great depth for our clients' benefit in defending them and preventing their exposure to claims.
Providing Preventive Services
We believe strongly that the best approach to litigation is prevention. To that end we provide training to clients and industry groups on a wide range of loss-prevention topics.
