Garvey Schubert Barer Legal Update, June 25, 2010.

The FCC is seeking comments on CenturyLink’s petition pursuant to section 1.3 of the FCC’s rules seeking a waiver of the deadline for implementation of one-business day number porting. See Public Notice, DA 10-1078 (rel. June 15, 2010).

The FCC’s new number portability rules, established in Local Number Portability Porting Interval and Validation Requirements; Telephone Number Portability, WC Docket No. 07-244, CC Docket No. 95-116, Report and Order and Further Notice of Proposed Rulemaking, 24 FCC Rcd 6084 (2009), streamline the number porting requirements and require most carriers (except small providers) to port numbers within one business day effective August 2, 2010; small providers must comply by February 2, 2011. CenturyLink has requested an extension of time until May 1, 2011, to implement the one-business day requirement because of operational issues.

Interested parties may file comments on the waiver petition on or before June 29, 2010; reply comments are due on or before July 6, 2010.
